These Terms of Service govern all purchases from and use of thebespokebibliophile.com. By placing an order or creating an account, you indicate that you have read these terms and agree to be bound by them. They form a binding contract between you and The Bespoke Bibliophile, a US sole proprietorship operating under that name.

If you do not agree to these terms, do not place an order.

1. Using This Site

You may use this site for lawful personal purposes only. Prohibited uses include, without limitation:

Automated harvesting or scraping of product data, pricing, or descriptions
Circumventing or tampering with checkout, pricing, or any site security feature
Placing fraudulent orders or using stolen payment credentials
Reproducing or redistributing any content from this site without written permission
Any use that violates applicable federal, state, or local law

Users under 13 may not create accounts or submit personal information. Users under 18 may not enter into contracts without the consent of a parent or guardian. We reserve the right to cancel orders placed in violation of these terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at curator@thebespokebibliophile.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms. Account deletion requests may be submitted by email; deletion does not cancel any pending order or waive any outstanding obligation.

3. Orders and Payment

An order confirmation email acknowledges receipt of your order; it does not constitute our acceptance of it. Our acceptance occurs when your order ships — or, for print-on-demand Bindery items, when your order is sent to print. We reserve the right to cancel any order before acceptance, including orders we cannot fulfill due to inventory limitations, pricing errors, or geographic service restrictions. If we cancel your order, you will receive a full refund by the method of original payment within 7 working days.

Prices are listed in US dollars and are subject to change without notice before an order is placed. Accepted payment methods are those displayed at checkout. Payment card data is processed by PCI DSS-compliant third parties (Shopify Payments, Stripe); we do not store full card numbers.

Services are not available in all US states. If your shipping address is in a state where we are unable to fulfill orders, your order will be cancelled and you will receive a full refund. You will be notified promptly.

4. Print-on-Demand Items (The Bindery)

Bindery journals are produced to order by Lulu Direct, a third-party printer. Production timelines are estimates and subject to Lulu Direct's capacity. The Bespoke Bibliophile is not responsible for delays caused by Lulu's production schedule, though we will communicate updates as received. Items ship directly from Lulu Direct's fulfillment centers and carry separate tracking numbers from any books in the same order. Your purchase of a print-on-demand journal grants a license to use the physical product only; no right to copy, reproduce, or distribute the interior content is conveyed. Copyright in any journal content remains with its respective creator.

5. Curiosity Cabinet Items (Dropshipped)

Select items in the Curiosity Cabinet are fulfilled by third-party vendors, which may include Faire and CJ Dropshipping. These items may ship separately from books in the same order, with separate tracking numbers and, in some cases, from fulfillment locations outside the United States. Product descriptions are provided by vendors and may differ in minor particulars from the physical item. We act as a reseller, not the manufacturer. Refund and return procedures for these items are described in the Refund Policy.

6. Intellectual Property

All original content on this site — including but not limited to written descriptions, the shop's name and branding, product photography produced by or for The Bespoke Bibliophile, and design elements — is the property of The Bespoke Bibliophile and may not be reproduced, distributed, or used without prior written permission.

Books listed for sale carry their own copyrights, which belong to their respective authors and publishers. The Bespoke Bibliophile makes no claim to the content of books sold here. Publisher and author names are the trademarks of their respective owners.

If you believe any content on this site infringes your copyright, contact curator@thebespokebibliophile.com with the subject line "Copyright Notice." Include a description of the claimed infringement, the location of the material on the site, your contact information, and a statement that you have a good faith belief that the use is not authorized. We will respond as required under applicable law.

7. Disclaimers

This site and its contents are provided on an "as is" and "as available" basis. We make reasonable efforts to keep product listings accurate, but we do not warrant that descriptions, images, or prices are free of error. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We are not responsible for delays, failures, or errors caused by circumstances outside our control — including carrier disruptions, print-on-demand production delays, vendor stock limitations, or events of force majeure. Where such circumstances prevent or delay fulfillment, we will notify you and offer the option to cancel for a full refund.

8. Limitation of Liability

To the fullest extent permitted by applicable law, The Bespoke Bibliophile's total liability for any claim arising from your use of this site or any order placed here is limited to the amount paid by you for the specific item or transaction giving rise to the claim. We are not liable for any consequential, incidental, indirect, special, punitive, or exemplary damages — including lost profits, loss of data, or business interruption — even if we have been advised of the possibility of such damages. This limitation applies regardless of the theory of liability (contract, tort, statute, or otherwise).

Some states do not allow the exclusion or limitation of certain damages; where that is the case, the above limitation applies to the maximum extent permitted by the law of your state.

9. Indemnification

You agree to indemnify and hold harmless The Bespoke Bibliophile from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of this site, your violation of these terms, or your infringement of any third party's rights.

10. Governing Law and Dispute Resolution

These terms are governed by the laws of the state in which The Bespoke Bibliophile is registered as a sole proprietor, without regard to its conflict-of-laws provisions. The consumer protection laws of your state of residence may also apply where they cannot be contractually waived.

Forum Selection: Any dispute not resolved by good-faith correspondence within 30 days of written notice to curator@thebespokebibliophile.com shall be brought exclusively in the state or federal courts of competent jurisdiction selected at the election of The Bespoke Bibliophile. You consent to personal jurisdiction in that forum.

Small-Claims Carve-Out: Notwithstanding the above, either party retains the right to bring an individual claim in a small-claims court of competent jurisdiction for matters within that court's jurisdictional limit.

There is no arbitration requirement in these terms. You are not waiving any right to a jury trial or court proceeding.

11. Severability

If any provision of these terms is found unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remainder of these terms will continue in full force and effect.

12. Entire Agreement

These Terms of Service, together with the Privacy Policy, Refund Policy, Shipping Policy, Accessibility Statement, and Cookie Policy, constitute the entire agreement between you and The Bespoke Bibliophile regarding your use of this site, and supersede any prior oral or written representations.

13. Modifications

We reserve the right to modify these terms at any time. Revised terms will be posted at this URL with an updated "Last Updated" date. Continued use of this site after revisions are posted constitutes acceptance of the revised terms for future transactions. For material changes, we will provide reasonable advance notice.
